The Union Ministry of Health and Family Welfare has proposed strict amendments to the Drugs Rules, 1945. The new regulations will empower licensing authorities to immediately suspend the manufacturing licence of any pharmaceutical company whose products fail critical quality checks.
This policy initiative aims to eliminate contaminated or ineffective medicines from the market instantly. By holding pharmaceutical firms strictly accountable, the government seeks to safeguard public health and rebuild global trust in India's drug manufacturing ecosystem.
Under existing protocols, regulators must complete a lengthy procedure before suspending a unit. They first issue a formal show-cause notice and wait for written replies from the manufacturer.
The draft amendment introduces immediate administrative action for serious quality failures. Regulators can suspend a facility's production license as soon as laboratory tests confirm a medicine as Not of Standard Quality (NSQ). The draft rules prevent rogue firms from producing or distributing dubious batches while undergoing regulatory review.
The draft framework places a strict legal obligation on pharmaceutical companies to conduct a comprehensive Root Cause Analysis (RCA) following any quality failure.
Instead of applying superficial remedies, manufacturers must inspect their entire operational chain:
Following the root-cause investigation, the company must execute effective Corrective and Preventive Action (CAPA). Corrective action resolves the immediate batch defect, while preventive action upgrades manufacturing standards so the error never recurs.
Under the proposed rules, a manufacturer cannot resume operations simply by promising future compliance. The local Licensing Authority must physically inspect the plant and verify the implemented CAPA steps.
The suspension remains active until government inspectors verify that the company has resolved all technical defects. If the company fails to satisfy safety inspectors, the government maintains the power to cancel the manufacturing licence permanently.
