Supreme Court stays UGC Equity Regulations 2026

On 29 January, 2026, the Supreme Court stayed the implementation of the University Grants Commission (UGC) Equity Regulations 2026. A Bench comprising the Chief Justice of India Suryakant and Justice Joymalya Bagchi highlighted “complete vagueness” in key provisions of the regulations and warned that they were susceptible to misuse.

On 29 January, 2026, the Supreme Court stayed the implementation of the University Grants Commission (UGC) Equity Regulations 2026, halting a controversial framework that had triggered campus protests, political reactions and multiple legal challenges within days of being notified.
The Court directed that the earlier 2012 UGC Regulations shall remain in force until further orders and issued notices to the Centre and the UGC. The next hearing in the matter will be held on 19 March.
A Bench comprising the Chief Justice of India Suryakant and Justice Joymalya Bagchi highlighted “complete vagueness” in key provisions of the regulations and warned that they were likely to be misused.
Justice Joymalya Bagchi concurred that while the Constitution permits protective measures for disadvantaged groups under Article 15(4), progressive legislation should not result in social regression. He also cautioned that vague provisions could be used for personal vendetta on campuses.

UGC notified new equity framework

On 13 January, the UGC notified the Equity Regulations 2026, replacing the 2012 framework that governed caste discrimination and equal opportunity in higher education institutions.
According to the UGC notification, these rules mandate all universities and colleges to establish Equal Opportunity Centres (EOC) and campus-level committees to inquire into complaints of discrimination and promote equality and inclusion.
The UGC said the move was taken in view of an increase in complaints related to caste-based discrimination and following cases such as Rohith Vemula and Payal Tadvi, which exposed shortcomings in the existing redressal mechanisms.
However, Regulation 3(c) of the new framework strictly defined “caste-based discrimination” as discrimination against Scheduled Castes (SC), Scheduled Tribes (ST) and Other Backward Classes (OBC), a provision that soon became the main point of contention.

Student protests on campuses and at UGC headquarters

Soon after the regulations were notified, protests erupted across university campuses, particularly among general category students.
Students demonstrated at Delhi University’s North Campus, gathered near the Arts Faculty and submitted a memorandum to the Proctor’s Office demanding withdrawal of the rules.
Protesters alleged that the rules were vague, divisive and lacked safeguards against false complaints, while also pointing to the absence of a clear grievance redressal mechanism for non-reserved category students.

Legal challenge reaches the Supreme Court

Subsequently, several individuals, including Rahul Diwan, Vineet Jindal and Mrityunjay Tiwari, filed petitions in the Supreme Court challenging the constitutional validity of the UGC regulations.
According to the petitions, the challengers argued that Regulation 3(c) violates Article 14 of the Constitution as it limits the definition of caste-based discrimination only to SC, ST and OBC, thereby excluding general category individuals who may also face caste-based harassment.
As per court proceedings, advocate Vishnu Shankar Jain, appearing for the petitioners, argued that discrimination cannot be presumed to occur only against one section of society and that the definition under the regulations is arbitrary and exclusionary.
The Bench suggested that the regulations may require expert review and directed that the 2012 UGC regulations shall remain in force until further examination.

What lies ahead

With the Supreme Court’s interim stay, universities and colleges across the country will continue to follow the 2012 framework to address discrimination and equal opportunity. The Centre and the UGC have been asked to file their responses, and the Court will hear the matter again on 19 March.

UGC (University Grants Commission)

In 1944, the Sargent Report first recommended the establishment of a university grants committee. By 1947, its scope had come to include all existing universities.
In 1948, the University Education Commission under the chairmanship of Dr. S. Radhakrishnan recommended its reorganisation in line with the UK model.
In 1952, the central government designated the University Grants Commission (UGC) to oversee grants for central universities and higher educational institutions; it was formally inaugurated in 1953 by Maulana Abul Kalam Azad and became a statutory body in 1956.
The headquarters of the UGC is located in New Delhi, with a chairperson, vice-chairperson and ten other members appointed by the central government.

Constitutional and legal safeguards:

Article 15: Empowers the State to make “special provisions” (reservation) for Scheduled Castes/Tribes in admissions to educational institutions (including private institutions, as added by the 93rd Amendment).
Article 46: Under the Directive Principles of State Policy, it provides that the State shall protect Scheduled Castes and Scheduled Tribes from all forms of social injustice and exploitation, and this provision serves as a major foundation for anti-discrimination laws.
The Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act, 1989: Criminalises acts such as denying admission in educational institutions or publicly insulting a member of a Scheduled Caste/Tribe.
