The Bankers' Books Evidence Bill, 2026 has been enacted to replace the century-old Bankers' Books Evidence Act of 1891, bringing banking evidence laws in line with today's digital and technology-driven financial system. This reform is part of the government's ongoing efforts to modernise financial regulations and improve ease of doing business.
The new Act will officially take effect from 1st October 2026, as notified by the government on 10th September 2026. This marks the formal transition from the outdated 1891 law to a framework better suited to modern banking practices, including digital, cloud-based, and electronic record-keeping.
Admissibility of electronic records: Electronic and digital banking records can now be used as valid and legally enforceable evidence, provided they are true copies of the original entries, show no unauthorised alteration, and remain free from any tampering that could affect their accuracy.
Compelling production of bankers' books: Bank officials still cannot be forced to produce banking records or appear as witnesses in cases where the bank is not directly involved, unless a Court orders it for a "special cause." This special cause is now clearly defined to include situations where the accuracy of records is doubtful, normal record-keeping has been disrupted, or the bank fails to comply with a Court's inspection order.
Application to other financial entities: The law continues to apply to banking businesses, post office savings banks, and money order offices. Additionally, the central government now has the power to extend these provisions to other financial sector entities through official notification, along with the authority to set specific conditions or modifications as needed.
