1993 batch Indian Revenue Service (IRS) officer Rahul Navin ,has been appointed as the acting director of the Directorate of Enforcement (ED) by the government of India on 15 September 2023 . He will be in office till the government appoints a regular director or until further order.
Rahul Navin replaced Sanjay Kumar Mishra whose tenure as Director of ED came to an end on 15 September 2023.
Controversy over Sanjay Kumar Mishra's tenure
Government of India appointed Sanjay Kumar Mishra ,a 1984 batch IRS officer as Director of ED on November 19, 2018 for a period of two years.
Later, by an order of November 13, 2020, the appointment letter was modified retrospectively by the Central government and his term of two years was replaced by three years.
In 2022 the central government promulgated an ordinance under which the central government had the power to extend the tenure of the Directors of Central Bureau of Investigation (CBI) and ED by upto two more years .
Invoking its power the central government extended the tenure of Sanjay Kumar Mishra in 2021 and again on 17 November 2022.
The frequent extension given to Sanjay Kumar Mishra as Director of ED was challenged in the Supreme Court . The Supreme Court held the two extensions given to Sanjay Mishra by the government as illegal ,However it allowed Sanjay Kumar Mishra to be the director of ED till 15 September 2023.
The Directorate of Enforcement was established in 1956 under the Union Ministry of Finance.
It enforces the criminal provisions of the Prevention of Money of Money Laundering Act (PMLA) 2022 , the Fugitive Economic Offenders Act 2018 and the civil sections of the Foreign Exchange Management Act (FEMA) 1999.
