The Ministry of Law and Justice has published a notification stating that the appointment of an additional judge, Justice Pradeep Kumar Srivastava, has been made permanent at the Jharkhand High Court. 

  • The appointment has been made in exercise of the power conferred by clause (1) of Article 217 of the Constitution of India. 
  • The President has given his pleasure to appoint Justice Pradeep Kumar Srivastava, who was previously serving as an Additional Judge of the High Court of Jharkhand.
  • The appointment will be effective from the date he assumes charge of his office. 
  • Justice Srivastava's appointment as a permanent judge was recommended by the Supreme Court Collegium on January 18. 

What is the Collegium System?

  • The collegium is a system through which appointments and transfers of judges are decided. It comprises the Chief Justice of India and the four senior judges of the Supreme Court. 
  • The Collegium is responsible for considering the elevation of Chief Justices and Judges of High Court to the Supreme Court, the elevation of Judges of High Courts as Chief Justices, and the elevation of Judges. 
  • In cases of disagreement, the majority view will prevail. Although the Indian Constitution mandates consultation with the Chief Justice of India for appointments to the judiciary, the collegium model evolved to ensure a fair and impartial selection process.

Appointment of High Court Judges

  • The appointment of the Chief Justice and Judges of the High Courts is governed by clause (1) of Article 217 of the Indian Constitution. 
  • The President of India has the authority to appoint the Chief Justice with consultation from the Chief Justice of India and the Governor of the concerned state. 
  • In the case of appointing other judges, the Chief Justice of the concerned high court is also consulted. 
  • If there is a common high court that serves two or more states, the president consults with the governors of all the concerned states.

The Jharkhand High Court is a relatively new high court in India, having been established in 2000. This court is responsible for overseeing legal matters within the state of Jharkhand. 

Currently, Shree Chandrashekhar has served as the chief justice of the Jharkhand High Court since February 20, 2023
